It's not worth the risk!
Fines of up to £10,000 per company or individual and prison sentences of up to 2 years are a real possibility,
and in the event of a conviction you and your company would be listed on the UK Border agency’s “name and shame” website.
At FlexPlus we also have a responsibility for ensuring legal working and since 2003 as a UKBA pilot scheme member,
we have developed systems and methods to ensure that every worker we send on assignment to you is thoroughly checked
for their “right to work" in the UK. Additionally Flex perform identity checks as a matter of procedure , an important
check in this security conscious world.
The expertise we have accumulated is second to none and has been endorsed by local UK Border Agency Officers.
Our tracking and document retrieval systems ensure we keep up to date with every Flex employee regardless of
nationality or race, and to protect your business from potential prosecution or threat.
An outline of your responsibilities:
- As an employer you have a responsibility to prevent illegal working (without discrimination)
- Undertake full checks as per the UK Border Agency's lists
- Inspect original documentation
- Satisfy the "reasonably apparent" UKBA rule
- Conduct pre-employment/repeat and ongoing checks
- Be able to provide an "excuse" (proof of compliance)
- Conduct a minimum of one annual check on "time limited" documents
- Obtain verification from the UKBA for certain documents
- Obtain sight of a Worker Registration Scheme certificate for employees from the A8 countries within 28 days of them starting work
- Ensure you have the correct documentation for employees from the A2 countries
- Ensure you obtained a Sponsor Licence from the UK Border Agency if you want to employ a migrant or enrol a migrant as a student
- Copy and store the documentation (for 2 years)
